Il Municipality of Messina will have to compensate the family with one million and 600 thousand euros Fabio Bonaccorso, the restaurateur who died on 10 April 2010 after a motorcycle accident which occurred due to a hole formed after the collapse of a manhole cover, which was literally swallowed up by the asphalt. This is the sentence issued by Gaetano Cundari, judge of the first civil section of the judge of Court of Messina.
The facts
According to the reconstruction of the victim's lawyers, Bonaccorsi was driving his Honda Cbr along Viale Regina Elena, near the Ogliastri district, when he suddenly lost control of the motorbike due to the poor conditions of the road surface and crashed into a parked car and a waste bin losing his life. According to the judge, there is “a clear cause-effect relationship between the tragic event and the road conditions. the testimony given and the municipal police report acquired in the case file leave no room for doubt regarding the ascertainment of the dynamics of the accident“. In the criminal trial, in 2012, two municipal managers were acquitted of manslaughter by the investigating judge Giovanni De Marco. For the Bonaccorso family lawyer, the lawyer Antonio Roberti, "the real problem of this tragic story is that in consideration of the current economic situation of the Municipality of Messina, it appears very unlikely that it will be possible to obtain, quickly and in full, the compensation established by the Court following a trial that lasted over eight years".
