Dangerous guard rails, Anas will have to compensate the victims

Important news regarding road safety, especially for motorcyclists and those traveling on two wheels. The Supreme Court of Cassation, ruling on a case in which a man ended up against the guard rail following a road accident which, like a blade, caused his death, ruled that Anas will have to compensate the damages for the 'happened. THE The man's family asked for compensation from Anas, the body responsible for protecting the provincial road where the accident occurred, and after two rejected attempts the Supreme Court judge accepted the appeal.

The ruling of the Court of Cassation states that “For an anomaly relating to the protection tools installed, the responsibility of the custodian public body is in any case configurable, unless the latter demonstrates that it was unable to do anything to avoid the damage. The function of the guard rail is ontologically to prevent any irregular driving behavior from leading the car to dangerous exits off the road".

With this decision, the precedent is created to state that if the guard rails cause serious injuries or even death, Anas will be held responsible and will therefore be required to compensate the victim or her family.
